PRACTICE

Since 1982, Mr. Wernick's practice has concentrated in information technology, computer law, data privacy, copyright, trademark, trade secret, and licensing law, with an emphasis on the legal and business needs of users as well as vendors involved in the computer and information industries.  He provides practical legal advice and strategic counseling to clients in connection with significant transactional and dispute resolution matters in technology, intellectual property, data privacy, e-commerce, content acquisition, outsourcing, licensing, and computer system acquisitions.  Mr. Wernick has also co-counseled with numerous attorneys in various transactions and dispute resolution matters.  Furthermore, Mr. Wernick has experience advising and counseling clients in business law and general corporate law matters, as well as real estate law matters.  In addition to his transactional work, he has represented clients in the United States District Courts, United States Court of Appeals, and the U.S. Supreme Court.

SERVICES

Preventive services include advising on the legal aspects of computer system acquisitions, outsourcing, electronic commerce, Internet legal issues including portal agreements and linking agreements, obtaining and protecting proprietary rights, licensing, obtaining security interests in intellectual property, intellectual property audits, privacy issues, and intellectual property due diligence in mergers and acquisitions, and multimedia projects. 

Remedial services include settlement negotiations, alternative dispute resolution, and litigation, covering such areas as computer user and vendor disputes, intellectual property disputes, and domain name disputes.

ACTIVITIES

Mr. Wernick serves in leadership roles in several national and international organizations involved with computer law and e-commerce issues.  He has published a law review article among numerous other legal and business articles.  Mr. Wernick is a frequent speaker and writer on computer law and intellectual property law issues, and has taught information technology, computer law, and intellectual property law to Masters of Business Administration students at The Ohio State University as well as to delegations of business representatives from China.  He currently serves on the advisory boards of several legal publications.  While at law school, Mr. Wernick won the law school's competition for Best Written Motion, received an award for his writing ability, was appointed research assistant to the Dean of the law school, and was a member of the Moot Court (Tax) team.  In addition to his law degree, Mr. Wernick has a technical background in computer programming and a B.S. in Accounting.
