Since 1982, Mr. Wernick’s practice has been concentrated in information technology law, copyright, trademark, trade secret, and licensing law. This practice is broadly segmented into two areas: “Preventive” and “Remedial.” His counseling and representation of clients are based on his nearly thirty years experience including law, technology, and accounting, and as an arbitrator and as a mediator. 

The Preventive part of Mr. Wernick's practice focuses on transactional, strategic and corporate representation of global "Fortune 500" companies, start-up and emerging growth companies, middle market companies, and non-profits. His experience includes structuring and negotiating technology and intellectual property-oriented strategic alliances and joint ventures; computer programs, data and content licensing; outsourcing, MRP and ERP implementation transactions; intellectual property and technology issues arising in the context of mergers and acquisitions, financing and bankruptcy transactions; counseling on digital strategy concerns including open source licensing and e-publishing, data security, data use and privacy issues (including GLB, HIPAA, and cross-border data privacy issues); ASP, hosting and software services agreements; internet portals, exchanges and marketplaces; research and development transactions; private labeling, co-branding and other marketing and distribution strategies; and venture capital investments. Mr. Wernick also provides general corporate representation to software, internet, e-commerce, technology, and consulting companies.  See the Legal Areas page for a partial listing of representative transactions. 

The Remedial part of Mr. Wernick’s practice includes dispute resolution through negotiations, alternative dispute resolutions such as mediation and arbitration, litigation in the federal courts including the United States District Court, United States Court of Appeals, and the United States Supreme Court. 

For more than twenty-five years Mr. Wernick has served as an Arbitrator, either as the sole arbitrator or as a member (often Chairman) of a three member arbitration panel, and as a mediator. The overwhelming majority of these cases involved complex user and vendor disputes regarding major computer system failures, information technology, licensing, or intellectual property disputes. From the arbitrator’s perspective, one gets to see how other parties put deals together, how the deals fell apart, and how other lawyers represent their clients in a dispute.
