Practice Focus Since 1982, Mr. Wernick's practice has been concentrated in information technology law, copyright, trademark, trade secret, and licensing law. This practice is broadly segmented into two areas: “Preventive” and “Remedial.” His counseling and representation of clients are based on his nearly thirty years experience including law, technology, and accounting, and as an arbitrator and as a mediator. The Preventive part of Mr. Wernick’s practice includes working on various transactions in a variety of industries and technologies, extensive contract negotiations and drafting, evaluating intellectual capital assets, prosecution and registration of intellectual property rights (not patents). The Remedial part of Mr. Wernick’s practice includes dispute resolution through negotiations, alternative dispute resolutions such as mediation and arbitration, litigation in the federal courts including the United States District Court, United States Court of Appeals, and the United States Supreme Court. For more than twenty years Mr. Wernick has served as an Arbitrator, either as the sole arbitrator or as a member (often Chairman) of a three member arbitration panel, and as a mediator. The overwhelming majority of these cases involved complex user and vendor disputes regarding major computer system failures, information technology, licensing, or intellectual property disputes. From the arbitrator’s perspective, one gets to see how other parties put deals together, how the deals fell apart, and how other lawyers represent their clients in a dispute.
